Drum sample legalities

I am working on a mobile drum sequencer app. If I take a hardware drum synth like an 808, and record my own samples, can I use these in an app that I might potentially sell?

err.. no. as far as I remember from the Buzz machine, Roland go after you the moment it starts resembling a TR.
then again I think as long as you're not calling it something "808" ("Ate oh wait" anyone?) it may have a chance of surviving.. double check, then check again.

i think its ok as long as he calls it 808 and not roland 808 or something like that.
just look at drum and bass with the amen the funky drummer etc.
theres been countless apps that do pretty much the same thing that hes doing and buzz for example that dinnt go the the legalities of every sample it used. rave box being one of them and that had the hole piano riff from liquid sweet harmony alla someday by ce ce rogers

Yes man for sure.

Now that I have one prototype out. I was going to churn out other versions with different samples.

Was thinking about calling it the Mobile Drums line with each rendition being like MB-XXX or something.

The first beta test version is going up today on play store. Will link it here soon.
